According to Senator Cynthia Lummis, the Clarity Act is the only viable pathway to grant the U.S. Commodity Futures Trading Commission (CFTC) regulatory authority over the spot digital asset market and enable new enforcement powers against counterparties. Lummis stated that administrative rules alone cannot achieve these objectives or protect developers from improper litigation, and only Congressional action through the Clarity Act can accomplish these goals.
