David Sacks Criticizes OpenAI for Weaponizing Regulatory Uncertainty Against Open-Source Competitors

David Sacks, chair of the U.S. President's Council of Advisors on Science and Technology, recently criticized OpenAI strategist Dean W. Ball for suggesting the U.S. government deliberately create regulatory uncertainty to discourage adoption of models like Kimi K3 from Moon-focused competitors. Sacks stated: "Weaponizing regulatory uncertainty as a competitive tool is completely unacceptable. Regulatory decisions must be grounded in facts, logic, and evidence, not designed to create fear and uncertainty." He warned that such tactics undermine American rule of law and set a precedent for future abuse of governmental power. Sacks noted that leading closed-source model labs have formed a revenue duopoly and are attempting to use government power to eliminate open-source competition, calling on Silicon Valley's open-competition advocates to speak out.
